Who we are and scope. Dynamic Exteriors LLC (“Dynamic Exteriors,” “we,” “us,” or “our”) is a Nebraska business located at 711 E 11th St, North Platte, NE 69101. This Privacy Policy explains how we collect, use, disclose, store, and protect personal information when you visit our website, submit a form, request an estimate, communicate with us by phone, email, or text message, receive SMS/MMS messages from us, or otherwise interact with our services. This policy applies to our consumer-facing website, estimate and contact forms, customer communications, and our A2P SMS/MMS messaging programs. CTIA guidance requires message senders to maintain and conspicuously display an easy-to-understand privacy policy that is accessible from the initial call-to-action and accurately describes collection, use, and sharing practices.

Information we collect. We may collect the following categories of information: your name; phone number; email address; service address; billing or project address; photos, videos, or notes you provide about your property or project; appointment and estimate details; project status information; records of your calls, texts, and emails with us; device or webform metadata such as IP address, browser details, form submission date/time, and page URL; and consent records related to texting, including the method of consent, disclosure language shown, campaign selected, and any opt-in or opt-out keywords used. These are the types of data CTIA and 10DLC sources expect message senders to document when consent is collected and maintained.

How we use information. We use personal information to respond to inquiries; schedule estimates, inspections, and project appointments; send quotes, invoices, receipts, service updates, weather or scheduling changes, and customer-care messages; administer and improve our website and communications; prevent fraud and abuse; comply with legal obligations; maintain do-not-contact and suppression lists; and, if you have provided the appropriate consent, send marketing or promotional SMS/MMS or other messages about our services, seasonal offers, financing information, and related promotions. CTIA and carrier sources consistently require that the message type match the consent collected and that one opt-in not be repurposed for unrelated campaigns.

Legal bases and consent for A2P SMS/MMS. For SMS/MMS, we will rely on the consent level appropriate to the message type and the applicable law. If you initiate a one-to-one text conversation and we respond directly and only with relevant information, we will treat that as conversational messaging. If you request project updates, appointment reminders, estimate scheduling, or other non-promotional messages, we will rely on your express consent for those informational messages. If we send promotional or marketing SMS/MMS, we will do so only after obtaining the prior express written consent required for that campaign and for Dynamic Exteriors LLC specifically; your consent to one seller, one campaign, or one type of text does not authorize different sellers, unrelated campaigns, or different marketing subject matter. We will not make consent to promotional texts a condition of purchasing goods or services. These rules reflect FCC, CTIA, T-Mobile, and AT&T guidance.

How you opt in. We may obtain your consent to receive texts from us through one or more of the following methods: a website form with a dedicated SMS checkbox and disclosure; a paper form signed by you; a text keyword you send to us; a phone call or in-person conversation that we document for informational texts; or your direct initiation of a conversational text exchange. For marketing texts, we will use a written consent flow that clearly identifies Dynamic Exteriors LLC, the kinds of messages you are agreeing to receive, the frequency disclosure, the fact that message and data rates may apply, and how to opt out or get help. CTIA and T-Mobile both require clear and conspicuous calls-to-action and campaign-specific opt-in, and AT&T Office@Hand materials specifically expect businesses to describe and document their consent method.

Message frequency. Message frequency depends on the program you join and your relationship with us. For customer-care, estimate, appointment, and project-status texts, message frequency may vary based on your requests, appointment changes, weather delays, active project scheduling, and account activity. For promotional texts, unless a more specific disclosure is shown at sign-up, we will limit our marketing program to up to 4 messages per month. Where a recurring messaging program is offered, our opt-in confirmation and call-to-action will disclose that the program is recurring and will state frequency. CTIA and the short code handbook treat frequency disclosure as a required program element for recurring messaging.

Fees and carrier notice. Message and data rates may apply to SMS/MMS sent to or from your mobile device, depending on your wireless plan. Carrier delivery is not guaranteed and may be affected by your mobile provider, handset, network conditions, or filtering systems. CTIA and the short code handbook require clear disclosure of message/data rates for recurring programs, and T-Mobile and AT&T reserve enforcement rights for non-compliant campaigns.

How to opt out and revoke consent. You may opt out of our SMS/MMS programs at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to one of our messages, by calling us at (308) 225-0863, or by emailing [email protected] with your request. We will treat any reasonable request to stop texting as a revocation request where a reasonable person would understand it that way. After we receive a valid opt-out, we may send one final confirmation text that only confirms the opt-out; after that, no further messages will be sent for that campaign unless you opt in again or another lawful basis applies. We will honor revocation requests within a reasonable time not to exceed 10 business days, and in practice we intend to suppress opted-out numbers immediately or as close to immediately as our systems allow. FCC, CTIA, AT&T, T-Mobile, and Verizon sources all support this approach.

HELP and customer support. Our help responses, first recurring confirmation messages, and customer-care messages may identify Dynamic Exteriors LLC, provide contact information, and remind you how to opt out. Cookies & Tracking Technologies

Our website may use cookies, pixels, analytics tools, and similar tracking technologies to improve website functionality, analyze website traffic, remember user preferences, and improve our services. These technologies do not collect SMS consent independently. You may disable cookies through your browser settings; however, some features of the website may not function properly.

Consent recordkeeping. We maintain records sufficient to demonstrate when and how you consented to receive messages from us. Depending on the opt-in method, those records may include the date and time of consent, the specific campaign, your phone number, your name or another identifier, the exact disclosure language or screenshot shown to you, the form or page URL, checkbox values, IP address and browser information, the employee or system that collected the consent, and any later opt-out or re-subscription event. CTIA and official 10DLC guidance specifically identify these categories of evidence as important consent records.

Data retention and deletion. We retain personal information only for as long as reasonably necessary for the purposes described in this policy, to provide services, to administer messaging, to resolve disputes, to defend legal claims, and to comply with legal and carrier obligations. As a standard rule, we intend to retain SMS consent and suppression records for 6 years after the later of the last message sent under that consent, the final customer interaction related to that campaign, or the date of revocation. We intend to retain internal do-not-contact records for at least 6 years as well. Where records are no longer needed, we will securely delete or anonymize them unless we must preserve them for legal holds, audits, tax, accounting, safety, or dispute-resolution reasons. This six-year retention period is a conservative policy choice because some mobile network operators require six-year opt-in documentation, while FCC do-not-call obligations require requests not to be called to be honored for five years.

Security measures. We use reasonable physical, administrative, and technical safeguards designed to protect personal information against unauthorized access, use, alteration, or disclosure. These measures may include role-based access controls, password protection, MFA where supported, vendor access restrictions, logging, secure cloud storage, encrypted transmission where available, routine software updates, and periodic review of our messaging and webform processes. CTIA expressly recommends reasonable physical, administrative, and technical security controls, testing, monitoring, and regular security risk assessments.

Third-party processors. We may use service providers to host our website, store form submissions, route emails, schedule appointments, provide CRM or job-management systems, process payments, store documents, and enable or transmit A2P SMS/MMS through approved messaging platforms, aggregators, or carriers. Those providers may process personal information only as needed to provide services to us or on our behalf, subject to contractual or technical restrictions when applicable. If we use an A2P vendor, aggregator, or campaign service provider, the vendor will also be subject to carrier and CTIA ecosystem requirements. T-Mobile and Verizon both emphasize the role of approved aggregators and sanctioned routes for non-consumer messaging.

Sharing and non-sale statement. We do not sell your personal information or your SMS consent to third parties for their own marketing. We do not rent, sell, or share SMS opt-in lists. We may disclose your information only to service providers acting on our behalf; to insurance, financing, inspection, or subcontractor partners if needed to perform requested services and consistent with your request; to government authorities or courts when legally required; or when necessary to investigate fraud, misuse, or security incidents. We will not use a consent obtained for one seller or one campaign as transferable consent for another seller or unrelated campaign. CTIA, FCC, T-Mobile, and AT&T sources support these restrictions.

International transfers. Dynamic Exteriors LLC is based in the United States and expects most processing to occur in the United States. If we use a vendor that stores or processes personal information outside the United States, we will take reasonable steps to require that the information remain protected in a manner consistent with this policy and applicable law. The primary U.S. A2P sources reviewed do not prescribe a specific cross-border transfer clause for small-business privacy notices; this section is included as a prudent general privacy disclosure.

Minors. Our services are directed to homeowners, property owners, and adult customers. We do not knowingly collect personal information online from children under 13 through a site or service directed to children, and if we learn that we have done so, we will delete the information as appropriate. The FTC’s COPPA materials explain that special rules apply to operators of websites or online services directed to children under 13, or operators with actual knowledge they are collecting online personal information from a child under 13.

Changes to this policy. We may update this Privacy Policy from time to time to reflect changes to our business practices, our vendors, legal requirements, or carrier and industry messaging standards. If the changes are material, we will update the effective date and, where appropriate, provide additional notice through our website, forms, or messaging flows. Carrier and industry policies can change, sometimes with limited notice, and CTIA expressly notes that stakeholders may implement additional requirements through their own policies and contracts.
